Both national and international travel is easier now than ever before, but that doesn’t mean that it isn’t free of complications.
If you’re an active user of hemp-based products like CBD, you might wonder about the legality of traveling with CBD, which you should be aware of. After all, an educated traveler is a happy one. Here at Axis Labs, we want to make sure you can enjoy your CBD products on the road, so we put together this quick guide on the current rules and regulations about traveling with CBD.
The first step of traveling with CBD is to make sure that it is legal to own and use in the places you’re traveling to and from. When derived from hemp, CBD is legal in all 50 states, but when derived from marijuana, local laws might say otherwise. If you travel with CBD to a state that has declared CBD illegal, you could risk being charged with possession. For instance, in the state of Texas, state law has made possession of any cannabis products, including CBD, a felony that results in a sizeable fine and a minimum of 180 days in state prison.
Additionally, these rules may change from country to country. It’s best to leave your CBD at home when traveling internationally.
Recently, the TSA announced on their Twitter page “Ask TSA,” that “Products that contain hemp-derived CBD oil or are FDA-approved are generally legal & can fly.” Basically, TSA is stating that any product or medication that contains hemp-based CBD is legal to bring on a plane as long as it fits within the regulations under the Agricultural Improvement Act of 2018.
Additionally, you’ll want to ensure that your CBD products, like tinctures or oils, are under the 3.4 oz limit for liquids if you pack it in your carry-on. It may be advisable to pack your CBD in your checked luggage if you will need more than that while you travel.
If you don’t feel comfortable bringing your CBD with you while you travel, you still have options. You can mail a few CBD products to your destination, which you can pick up when you arrive. Just make sure you give yourself enough lead time. You don’t want to arrive before your package does. Alternatively, you can find a store at your destination that carries your preferred brand.
